TERMS AND CONDITIONS 

Course bookings can be made with Lumify Work Philippines over the phone, via email or via the Lumify Work Philippines website. 

Individual promotion terms and conditions can be found at the bottom of the relevant promotion. 

1. APPLICATION OF THESE TERMS 

Only these booking terms and conditions will form part of the agreement between the parties and will apply to any booking placed, goods received, or attendance at any course that is facilitated by Lumify Work Philippines, regardless of the process leading to a booking or the mechanism of payment used in respect of such goods or services. Acceptance of any purchase order will not constitute acceptance of any terms or conditions which may be attached to, or incorporated in, a purchase order. 

2. SUPPLY OF GOODS, SERVICES AND SOFTWARE 

  1. DDLS Aboitiz Inc. (Lumify Work Philippines) agrees to supply goods, software (“Products”) and/or services (“Services”) to a purchaser, attendee, student or course recipient (“Client”, “You” or “Your”) on these standard terms and conditions (“Terms”). 

  2. The details of all training events, programs, tools, publications and other products are confirmed and correct at the time of publication but are subject to change without notice. Lumify Work Philippines reserves the right to amend any details, courseware or content at any time. Lumify Work Philippines assumes no responsibility for non-refundable airline tickets or other expenses incurred due to course cancellations. If a course is cancelled by Lumify Work Philippines, the paid seat for the course is transferable. 

3. PURCHASE ORDERS (FOR CREDIT CLIENTS ONLY) 

Any amendments to these Terms for the supply of Products or Services must be approved by Lumify Work Philippines in writing to be effective. Only these Terms (specifically excluding other terms and conditions which may be attached to, or incorporated in, a purchase order) form part of the agreement between the parties. Acceptance of a purchase order will not constitute acceptance of any such terms or conditions. 

4. TAXES AND GST 

Although the quoted price is in Philippine Pesos, the total amount payable to Lumify Work Philippines includes taxes, duties and government charges imposed or levied in Philippines in connection with the supply of the Products and Services. The client must pay any VAT payable in connection with the supply and Lumify Work Philippines will issue a valid tax invoice where VAT is to be recovered. 

5. BOOKINGS AND PAYMENT 

  1. Bookings are made on a “first-come, first-served” basis. If the course or event is already fully booked, applicants will be placed on a waiting list. 

  2. Payment can be made by EFT, Cheque, and Credit Card,Note that the course is not confirmed until payment is received, or a signed proposal or Purchase Order is received from client. 

  3. Payment is due at the time of booking unlessotherwise agreed upon. Any discount which Lumify Work Philippines may have granted to Client is forfeited by Client if payment is not made to Lumify Work Philippines by the due date. Payment of undisputed amounts must not be withheld pending the settlement of any claims or disputes. 

6. ATTENDANCE 

  1. All courses will be run between business hours unless specified or agreed otherwise. 

  2. If You are late for your course, Lumify Work Philippines reserves the right to decline your admission to the course. 

  3. You are required to provide proof of identity for exams and certifications. 

  4. All course prerequisites, as specified by Lumify Work Philippines in the course outlines, must be met prior to attendance. 

  5. If a student feels a course is not appropriate for them, they must advise the instructor by lunchtime on the first day of the course to be eligible to transfer to an appropriate course. All materials provided by Lumify Work Philippines must be returned to Lumify Work Philippines. 

  6. If a student fails to attend the course, 100% of course fees are payable and non-refundable. 

7. COURSE CONDITIONS 

Public and Private Courses 

  1. Refunds are NOT available for bookings if a student cancels the booking within the ten business days before course commencement. 

  2. A “private course” means a course organised exclusively for the organisation purchasing the training, where course participants are restricted to those selected by the company. A private course can be held on the Client’s site or at Lumify Work Philippines premises. 

  3. In order to confirm a private course booking date and the associated resources required to run the course, payment is required at the time of accepting the Lumify Work Philippines private course quote. 

  4. Lumify Work Philippines makes no warranty in relation to the Products or Services other than as contained in these Terms or as prescribed by a law which cannot be excluded, or in the case of Products, as provided by the Products’ respective manufacturers as made known to the Client in the documents supplied by Lumify Work Philippines or the manufacturer or as otherwise published or made known to the Client. 

Additional Terms Required by Specific Vendors 

The provision of courseware from certain vendors requires certain amendment or variation of these Terms. The list of vendors and relevant terms are found further down this page. 

Examinations and Examination Vouchers 

  1. Where an examination voucher is provided (whether or not included as part of a bundled product or service provided by Lumify Work Philippines) its issuance and use is governed by these general Terms as well as any Additional Terms required by the specific Authorised Testing Provider and/or Vendor applicable to that voucher, which terms are available for review at the host websites of the Authorised Testing Provider and/or Vendor. 

  2. Examination vouchers may be redeemed only for the Authorised Testing Provider and Vendor and testing program for which they were supplied. 

  3. Examination vouchers are not transferable between programs. 

  4. Examination vouchers are not returnable or refundable. 

  5. Examination vouchers must be redeemed, and the examination must be taken prior to its expiration date otherwise the voucher will become invalid. 

  6. Lumify Work Philippines accepts no responsibility to participants with respect to expired vouchers. It is the responsibility of each participant, not Lumify Work Philippines, to ascertain the validity period of any voucher supplied (most commonly between 6 and 12 months from the purchase date). 

  7. If the examination is no longer available, no substitution can be made. 

  8. The examination can only be taken for the course that was attended. 

  9. Examinations are not transferable between programs. Examinations are not returnable or refundable. 

  10. It is the responsibility of each participant who proposes to sit any examination to be present for the examination at the due time and to be in possession of the required identification and documentation. 

  11. Lumify Work Philippines is unable to process booking changes to any scheduled examination and participants must contact the Authorised Testing Provider directly with respect to all administrative matters concerning an examination. 

8. CANCELLATIONS AND TRANSFERS 

Public Courses 

Notification of cancellation must be received in writing 10 or more working days prior to course commencement. In order for you to cancel a course, you must advise via email and receive a Lumify Work Philippines acknowledgement of the email.  All requests to cancel or change public course dates must be made in writing to Lumify Work Philippines no less than 10 business days prior to the commencement date of the course. 

Cancellations and date change requests received less than 10 business days prior to the start of the course will incur a fee of 100% of the total course price. 

Private Courses 

All requests to cancel or change private course dates must be made in writing to Lumify Work Philippines no less than 10 business days prior to the commencement date of the course. Cancellations and date change requests received less than 10 business days prior to the start of the course will incur a fee of 100% of the total course price. 

Substitution of students is accepted up to 4 days before course commencement and requires you to notify Lumify Work Philippines in writing. Students who fail to attend training will be charged in full. 

Transfers 

Where a transfer is approved, the replacement course must be booked and sat within 12 months from the date of payment of the original course. 

9. RISK 

Lumify Work Philippines is not liable for the loss or theft of, or damage to your property when attending courses and/or exams. 

You acknowledge and agree that any use of the provided facilities, tea, coffee or equipment outside the conduct of a course on Lumify Work Philippines premises is entirely at Your own risk. Attendees are obliged to comply with the relevant rules of conduct for the course venue. 

You must comply with Lumify Work Philippines Workplace Health and Safety policies. Any smoking during breaks may only occur off premises. Risk of loss, theft, damage, deterioration, or destruction of Products passes to the Client upon the earlier of: 

  1. delivery to the Client. 

  2. the taking of possession by the Client; or 

  3. delivery to any carrier contracted to the Client for delivery to the Client. 

10. TITLE 

Until the Products have been paid for in full, they remain the property of Lumify Work Philippines. If the Client fails to pay any monies to Lumify Work Philippines when due, Lumify Work Philippines may immediately, without notice or demand, enter upon the Client’s premises and take possession of the Products. This right is without prejudice to any other rights that Lumify Work Philippines may have. 

11. CONFIDENTIALITY 

Unless stated as confidential, any ideas, remarks, questions, data, graphics or the like which You send to Lumify Work Philippines will be deemed non-confidential. Lumify Work Philippines will be entitled to use or disclose this information in any manner it chooses, without liability or notice to You. 

Lumify Work Philippines and You agree to keep at all times as strictly confidential any Confidential Information that is disclosed or provided by one party to the other. In this clause, “Confidential Information” means information in any form but does not include information that is required to be shared by Lumify Work Philippines with a vendor to obtain courseware, accreditation, or licensing rights, or is already in the public domain at the time that it is disclosed or becomes part of the public domain, otherwise than as a result of an unauthorised disclosure by Lumify Work Philippines or the Client. 

12. PRIVACY 

All information that Lumify Work Philippines collects in connection with Your purchases or bookings will be treated in accordance with the Lumify Work Philippines Privacy Policy. Lumify Work Philippines will collect, use, and disclose Your personal information for the purpose of enabling You to enroll in a course, and to allow Lumify Work Philippines to deliver the course and related Products and Services to You. 

Lumify Work Philippines uses Your information to: 

  • Communicate with You about Your course, events, activities, products, services and opportunities available to You; 

  • Disclose your personal information to overseas vendors. Such vendors are those relevant to the course, products or courseware You have requested from Lumify Work Philippines; 

  • Carry out and record your details in internal administrative matters; and 

  • Fulfil any vendor requirements regarding your attendance for certification, planning, administration, policy development, program evaluation and other related or lawful purposes. 

13. INTELLECTUAL PROPERTY 

The Client acknowledges that, unless otherwise agreed in writing, all content provided is copyright and all intellectual property rights attaching to the Products or arising out of the provision of Services are, and will remain, the property of Lumify Work Philippines (or the relevant vendor, where such rights are owned by a vendor). Material or courseware cannot be copied, reproduced, or distributed without the express permission of Lumify Work Philippines or the relevant vendor. All material provided or shown is for the sole use of the course attendee and any usage rights are only conferred on payment of all charges payable in connection with those rights. 

14. NO REPRESENTATIONS 

The Client acknowledges that Lumify Work Philippines has not made any warranty or representation, express or implied, in relation to the Products or the Services, including whether they are suitable for a particular purpose (whether such purpose was made known to Lumify Work Philippines or not), unless provided in writing. 

15. NO IMPLIED TERMS 

To the fullest extent permitted by law, the parties agree to exclude any terms which would otherwise be implied into these Terms by any statute. The liability of Lumify Work Philippines for a breach of a condition or warranty implied into these Terms by the Competition and Consumer Act, 2010 is limited at the option of Lumify Work Philippines: 

  1. if the breach relates to goods, to the replacement of the goods or the supply of equivalent goods, or the repair of the goods, or the payment of the cost of replacing the goods or of acquiring equivalent goods or the payment of the cost of having the goods repaired; and 

  2. if the breach relates to services, the supplying of the services again, or the payment of the cost of having the services supplied again. 

16. LIMITATION OF LIABILITY 

To the extent permitted by law, all express or implied warranties, representations, statements, terms, and conditions relating to Lumify Work Philippines or the provision of Products and/or Services under these Terms, not expressly set out in these Terms, are excluded from the agreement between the parties. 

Lumify Work Philippines aggregate liability, whether arising from breach of contract, negligence or any other tort, breach of warranty, under an indemnity, or statute, in equity or otherwise is limited to an amount equal to the total amount paid to Lumify Work Philippines for the relevant invoice under which the liability has arisen. Nothing in clause 16 operates to limit Lumify Work Philippines liability for: 

  1. claims for death, personal injury or damage to tangible property; or 

  2. claims for breach of a third party’s intellectual rights. 

Lumify Work Philippines has no liability to the Client for any incidental, indirect, special or consequential loss or damage, or for loss of or corruption of data, loss of use, revenues, profits, goodwill, bargain, opportunities or anticipated savings, whether arising from breach of contract, negligence or any other tort, in equity or under an indemnity, warranty or otherwise, whether or notLumify Work Philippines was aware of the possibility of such loss or damage. 

17. GENERAL 

Legal notices must be in writing and sent by mail, hand delivery or transmitted by facsimile to the address or facsimile number of the receiving party and are deemed delivered, in the case of: 

  1. hand delivery, on delivery; 

  2. posting, three days after dispatch; and 

  3. facsimile, on completion of complete and legible transmission. 

No leniency, indulgence or extension of time granted by Lumify Work Philippines to the Client will prejudice any of Lumify Work Philippines’ rights in any way or constitute a waiver of any of Lumify Work Philippines rights. If any of these Terms are for any reason declared to be or become unenforceable, invalid or illegal, the remaining Terms will remain in full force and effect. 

These Terms are governed by the laws of Philippines and the parties agree to submit to the non-exclusive jurisdiction of the courts of Philippines. 

These Terms, the applicable quotation and the payment constitute the entire agreement between the parties on the subject matter and supersede any previous understanding or agreement on that subject matter.

AWS Courses

Quantum Leap and Partner Accelerator programs 

You are participating in instructor-led or self-paced digital classes, labs or other training sessions (“AWS Training Services”) delivered by Lumify Work Philippines, which is an AWS authorised training partner. You acknowledge that Lumify Work Philippines will disclose information about your participation to AWS. This information will include a record of your attendance, the results of any training test or quiz, responses to surveys, and personal data such as the name and the email address used to register for the Training, (collectively “Training Data”). AWS will process personal Training Data in accordance with the AWS Privacy Notice, available at aws.amazon.com/privacy. Lumify Work Philippines will disclose the Training Data to AWS for certain legitimate business purposes including to: (a) confirm that Lumify Work Philippines has delivered the Training in accordance with the terms agreed between AWS and Lumify Work Philippines, (b) confirm that you have has successfully undertaken the AWS Training Services in order to determine Lumify Work Philippines is eligible for AWS provided funding for AWS Training Services, and (c) identify additional Training that might be of interest to you or Lumify Work Philippines.

CISCO COURSES 

Cisco Learning Credits: For students to receive a refund, they must cancel or reschedule their registration 18 or more calendar days before the class start date. 

Remote Labs: A number of Cisco courses include remote labs which come with a cancellation fee. These cancellation fees will apply if you cancel your course booking within 14 days of the scheduled start date.

HDI / HDAA COURSES 

HDI service support courses are delivered in partnership with HDAA. 

Payment is required at the time of booking. 

Cancellations must be received in writing at least 30 working days before course commencement. In order to cancel you must advise via email to [email protected]. A cancellation of enrolment received within twenty one (21) to thirty (30) working days of the scheduled course commencement date will incur a $330 administration fee. No refund of course fees will be made if a cancellation is received with less than twenty one (21) days notice of the scheduled course date. 

Transfers between scheduled courses will be accepted if received with no less than twenty one (21) days notice prior to the scheduled course date. Any transfer of enrolment received within twenty one days of the scheduled course date will incur a $220 administration fee. 
Attendee Substitutions will always be accepted. Please attempt to provide no less than 48 hours notice prior to the commencement of the scheduled course if a substitute attendee is necessary. 

If a student does not attend a scheduled session, there will be no refund or reschedule given. Payment is forfeited. 

Lumify Work Philippines reserves the right to change dates, courses and fees without notice. Lumify Work Philippines assumes no responsibility for non-refundable airline tickets or other expenses incurred due to course cancellations.

ISTQB / PLANIT COURSES

Red Hat Public Courses 

  1. Payment is required at the time of booking. 

  2. Cancellation notifications after 15 full working days prior to course commencement date (not including class start date) are not eligible for refund. 

  3. Students are allowed 2 reschedules per class up until 15 working days before course start date. The new session date must be given at the time of the reschedule notification and rescheduled classes must be taken within 6 months of original scheduled date. Rescheduling requests made 15 full working days or less prior to the start date of the class/exam will incur a penalty of 25% of RRP. The penalty fee will be added to the student’s original class/exam cost. Classes/exams that are rescheduled cannot later be cancelled. 

  4. Payment must be made in full prior to any rescheduling. 

  5. Student substitutions can be made 48 hours prior to a class start. 

  6. If a student does not attend a scheduled session, there will be no refund or reschedule given. Payment is forfeited. 

  7. In order to maintain a classroom environment that is conducive to learning, Red Hat reserves the right to dismiss a participant from any Red Hat training or certification event. A participant who harasses other participant(s) or Instructor(s) or who in Red Hat’s sole judgment acts inappropriately or disruptively during class may be dismissed from the class or event and may not return to the premises. In case of such dismissal, Red Hat’s liability will be limited to the refunding of any fees paid by participant or participant’s organisation in respect of the course and Red Hat shall not be responsible for any consequential loss or inconvenience arising whatsoever. 

  8. For exams purchased as a bundle with a course, the exam validity period begins from the time the order is placed regardless of when the class is running. 

  9. RHCSA or RHCE exam candidates must provide a government-issued identification (ID) at the time of the exam. A government-issued photo ID is preferred and should be used if available.

TOGAF / EA Learning Courses

TOGAF and Applied Architecture courses are delivered in partnership with EA Learning.

Payment is required at the time of booking. Exam vouchers and training materials will not be released until payment has been received.

Cancellations and registration amendments must be made in writing and sent via email to [email protected].

  • 4 or more weeks prior to the scheduled course start date, the client may cancel with a full refund, transfer to an alternate course date, or send a substitute attendee. 

  • 2 to 4 weeks prior to the scheduled course start date, the client may nominate a substitute attendee or defer to a future course. For deferrals, a fee of AUD $500 + GST for in-person courses and AUD $200 + GST for virtual courses will be charged. Once payment is received, an alternative date will be confirmed. 

  • 1 to 2 weeks prior to the scheduled course start date, the client may nominate a substitute attendee only. 

  • Cancellations within 1 week of course start date or those who fail to complete the course or are absent for any part of the course, are not entitled to a refund or deferral. 

Exam vouchers are valid for 12 months from the date of issue. 

Lumify Work reserves the right to change dates, courses, instructor, and fees without notice. Lumify Work assumes no responsibility for non-refundable airline tickets or other expenses incurred due to course cancellations. 

Students must satisfy course prerequisites as specified in Lumify Work course outlines.

VMware Courses 

  1. Payment is required at the time of booking. 

  2. Course fees are 100% refundable if I cancel my order at least 10 business days prior to the date of the class. 

  3. Course fees are not refundable if I cancel or change the class less than 10 business days prior to the date of the class. 

  4. I can avoid the cancellation fee if I designate another person to attend the class in my place. I understand that substitutions may be made at any time – even on-site at the conference. (Please have the substitute bring your letter of confirmation to the registration desk). 

  5. If I cannot attend the class and fail to notify Lumify Work Philippines prior to the date of my class, I will forfeit my entire course fee. Cancellations and other course changes may be made by emailing us: [email protected]

  6. I understand that Lumify Work Philippines reserves the right to cancel or reschedule any class. If a cancellation or rescheduling is necessary, I understand that Lumify Work Philippines will make every effort to notify me at least 10 business days in advance. 

  7. Unfortunately, last-minute cancellations and rescheduling sometimes require this notification period to be less. I will consider this when making my travel plans, as Lumify Work Philippines will not, in any way, be held responsible for any costs, including loss of airfare or other transportation costs, hotel expenses, or other damages that I may incur in the event thatLumify Work Philippines cancels or reschedules a class, except that Lumify Work Philippines will refund the tuition only. 

  8. Export Controls: The VMware Course Materials are of United States origin and are provided subject to the U.S. Export Administration Regulations. Diversion contrary to U.S. law is prohibited. Without limiting the foregoing, you agree that (1) you are not, and are not acting on behalf of, any person who is a citizen, national, or resident of, or who is controlled by the government of, Cuba, Iran, North Korea, Sudan, or Syria, or any other country to which the United States has prohibited export transactions; (2) you are not, and are not acting on behalf of, any person or entity listed on the U.S. Treasury Department list of Specially Designated Nationals and Blocked Persons, or the U.S. Commerce Department Denied Persons List or Entity List; and (3) you will not use the VMware Course Materials for, and will not permit the VMware Course Materials to be used for, any purposes prohibited by law, including, without limitation, for any prohibited development, design, manufacture or production of missiles or nuclear, chemical or biological weapons.
